RENTAL AGREEMENT

TrailerMeSomewhere LLC — Equipment Rental Contract

Agreement Overview

This Agreement is between TRAILERMESOMEWHERE, LLC, a North Carolina limited liability company ("TRAILERMESOMEWHERE"), and the Renter. TRAILERMESOMEWHERE hereby rents to the Renter certain equipment including but not limited to: Trailer, Tow Dolly, Car Hauler, Storage Container, Forklift, Shed, or Skyjack (the "Equipment"), subject to the terms and conditions set forth below.

Rental Period & Rates

The Renter agrees to pay the designated daily or weekly rate for each rental day or consecutive week as agreed upon at the time of booking. A security deposit is required and will be held in trust for the performance of the terms under this Agreement and any damages caused by the Renter or their agents.

Security Deposit: A $150 deposit is required at booking. The deposit will be held for 15 business days after the return of the rental equipment. Tolls, tickets, and damages during your rental will be deducted from your deposit.

Prohibited Uses

The following acts are prohibited and constitute a breach of this Agreement. You acknowledge that the Equipment:

  • Is not to be operated by any impaired person
  • Is not to have the weight capacity exceeded
  • Is to be operated by licensed drivers, at least 20 years of age
  • Is to be operated in compliance with all State and City laws
  • Is not to be taken on beaches, dunes, or off-road locations including sidewalks

Assumption of Risk

You understand that you are participating in an activity with possible risks to yourself and others, including the risks of death, serious bodily injury, and property damage. You are responsible for the safety of yourself and any property that you have in or on the equipment. You voluntarily assume all risk of accident or damage to your person or property which may be incurred from or be connected in any manner with your use, operation, or rental of the equipment.

Release & Indemnification

You hereby release us, our officers, directors, employees, representatives, agents, and management companies from all claims, demands, actions, and from all liability for damage, loss, or injury that may arise out of, or you may sustain, in connection with your use, operation, or rental of the equipment. You further agree to indemnify and hold us harmless from all claims, demands, actions, causes of action, including attorney's fees, expenses, and costs. This release and indemnification shall be binding upon your heirs, administrators, executors, and assigns.

Condition & Return of Equipment

You must return the Equipment to the designated return area one (1) hour before dusk/sundown on each Rental Day, in the same condition received except for ordinary wear. The Equipment remains TRAILERMESOMEWHERE's property, and failure to return it on the agreed date may constitute larceny.

Trailer Tire Wear

The Renter will notify TRAILERMESOMEWHERE when a trailer's tire reaches 4/32 of an inch of tread depth and/or when the brake lining reaches 3/8 of an inch of wear remaining so maintenance can be performed.

Insurance

The Renter shall be responsible to maintain insurance on the Equipment with losses payable to TRAILERMESOMEWHERE, LLC against fire, theft, collision, and other risks as specified. Upon request, the Renter shall provide proof of such insurance.

Damage Responsibility

You are responsible for all damage to or loss of the Equipment, including cost of repair, actual cash retail value if not repairable, theft, loss of use, diminished value, and reasonable administrative expenses — whether or not you are at fault. You must report all accidents, theft, and vandalism to the police and to us as soon as discovered.

Cargo Loss & Damages

TRAILERMESOMEWHERE will not be liable for loss of or damage to any cargo, goods, or property in, carried on, or towed by the Equipment. You agree to defend, release, indemnify, and hold TRAILERMESOMEWHERE harmless for all damages and defense costs arising from cargo loss or damage.

Cancellation Policy

Cancellation Fee: A $25 fee will be deducted from your deposit if the Renter cancels within 24 hours before the scheduled pickup of the rental.

Governing Law

You agree that this Agreement and any dispute arising therefrom shall be determined by the courts of Queens County, New York, and under the laws of the State of New York. Unless prohibited by law, you release us from any liability for consequential, special, or punitive damages in connection with this rental.
